In Virginia, all hemp retailers must register annually with the Virginia Department of Agriculture and Consumer Services (VDACS), even if they only sell pre-packaged products.

  • Retail hemp products containing more than 0.3% total THC are classified as marijuana under Virginia law and cannot be sold without proper authorization.

  • Every hemp product sold must include a valid Certificate of Analysis (COA) from an independent laboratory showing accurate THC and CBD concentrations.

  • Retailers are required to verify the age of all customers and may not sell hemp-derived products to anyone under 21 years old.

  • Businesses that fail to comply with VDACS regulations can face civil penalties of up to $10,000 per violation, product seizures, or suspension of their hemp registration.
